Estate Administrators

Our candidate legal practitioner, Ms. Georgia Benade is employed at the Master of High Court and specifically deals with the administration of deceased estates and liquidation of companies alike.KLP thus have excellent skills set in dealing with liquidation, administration deceased estates, and drafting of wills and testaments.

Alternative Dispute Resolution

Not only is KLP well versed with court-annexed ADR processes in the High Court of Namibia, but KLP through its consultant Brian Katjaerua also has exposure to, and well experienced in offering private arbitration services (FIDIC included) as well as assisting clients with drafting valid arbitration agreements.

Notary Service

Mrs. Katjaerua and Marie Wessels are both Notary Publics since 1 August 2018. As result, KLP offers a range of services to its clients including preparation and lodgment of anti-nuptial contracts and for company registration  

Intellectual property

Mrs. Katjaerua has successfully completed studies of the law of intellectual property rights as part of her LLM and will be offering this service. KLP successfully registered a trademark for its corporate client: “I am Namibia, I am Namibian”.

Esmeralda has close to 8 years’ litigation experience and is assisted by Ngakumbirue “Katji” who has close to 4 years post-admission experience. We have been exposed to a number of high-profile cases including urgent applications in the past, appearing alongside much-respected advocates in seeking justice on behalf of clients. There is an abundance of well-documented jurisprudence to support this. We advise clients on various legislation such as the PEGA 2019, FIA, procurement, banking law, and financial services laws. Our clients include financial institutions, mining companies, and other private businesses.

Conveyancing

KLP provides conveyancing services through its trusted and experienced consultant, Ms. Marlé Wessels a conveyancer with over 20 years of experience and is well known in the industry. KLP conveyancing services include but are not limited to bond registrations, transfers, developments, registrations of notarial deeds, bond takeovers amongst other related matters.KLP already runs the Legal Perfect and E4 Software through which all commercial banks provide their instructions. Our clients include financial institutions, estate agents, and other private businesses and individuals. Marle is assisted by Vipua Tjiho as well as Carla Nguasena as the conveyancing secretaries.

Corporate (Company law) & Commercial matters

KLP advises on its corporate clients on various areas of corporate law (company law), corporate governance and commercial matters. To this end, legal opinions are provided in various areas of law.

Contracts (drafting, advising on contractual disputes inclusive of FIDIC construction contracts and international business transactions)

One of the unique skills that KLP possesses is in the field of not only reading, reviewing and advising on a variety of contracts, but also actually drafting it. These range from straightforward sales agreements to more complex agreements such as joint ventures, construction contracts, engineering contracts, procurement of IT services agreements, inclusive of maintenance agreements, arbitration agreements etc.

Regulatory/Policy Interpretation/Compliance, analysis, review and drafting – with particular focus on public institutions

The services offered with regard to this field range from pure statutory interpretation (inclusive of transport legislation) and advice, and assistance in drafting and or aligning internal policies to governing legislation. This also includes advice on administrative law matters as applicable to public institutions, with a particular focus on providing advice on powers of these institutions and their boards vis-à-vis their governing legislation and policies. To this end, KLP has in the past year provided public institutions with internal policies relating to the Public Procurement Act of 2015, SOE Act, and Public Enterprises Governance Act of 2019.

Labour matters, inclusive of assistance with drafting on human resources policies and procedures

Mrs. Katjaerua has been chairing and continues to chair many disciplinary inquiries at FNB and other private companies and also provides legal advice in this field. She has assisted NASRIA and other corporate giants with updating of its human resources policies. She is well versed with all provisions of the Labour Act 11 of 2007, as amended, and with the appearance and resolution of Labour disputes (Office of the Labour Commissioner).KLP also represents the Foschini Group, First National Bank, GIPF, and other private individuals and businesses. The unique value proposition offered by KLP is its Training Workshop on Disciplinary Inquiries and Enterprise Risk Management Programme. The course is structured primarily for those in supervisory and management positions who are tasked with managing staff disciplinary issues as part of their overall management responsibilities. KLP has provided this training to First National Bank and GIPF. We believe this course is of immeasurable value to our existing and prospective clients.
